1. The FaithGPT Service

FaithGPT is an artificial intelligence-powered platform designed to assist users with faith-based conversations, Bible study, prayer journaling, scripture insights, and related spiritual content. The Service utilizes large language models (LLMs) and other AI technologies to generate responses and content.

AI-Generated Content Disclaimer: All responses generated by FaithGPT are produced by artificial intelligence systems. While we strive to provide helpful, accurate, and theologically sound content, AI-generated responses may contain errors, inaccuracies, or content that does not align with your specific faith tradition or denomination. FaithGPT is not a substitute for:

• Professional theological or pastoral counsel
• Medical, psychological, or mental health advice
• Legal or financial guidance
• Emergency services or crisis intervention

If you are experiencing a crisis or emergency, please contact appropriate emergency services or mental health professionals immediately.

2. Acceptance of Terms

By accessing or using FaithGPT, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and Cookie Policy. If you do not agree with any part of these Terms, you must not access or use our Service.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Changes to Terms

FaithGPT AI Inc. reserves the right to modify these Terms at any time at our sole discretion. When we make material changes, we will notify you by updating the "Last Updated" date at the top of these Terms and, where appropriate, provide additional notice (such as via email or through the Service). Changes will be effective immediately upon posting unless otherwise stated.

Your continued use of FaithGPT after any changes indicates your acceptance of the revised Terms. If you do not agree to the modified Terms, you must discontinue use of the Service. We recommend reviewing these Terms periodically to stay informed of updates.

4. Eligibility and Account Registration

Age Requirements: You must be at least 13 years old to create an account and use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms.

Kids Mode: FaithGPT may offer a "Kids Mode" or similar feature designed for younger users. Use of such features by children under 13 requires verifiable parental consent in accordance with the Children's Online Privacy Protection Act (COPPA) and similar laws. Parents and guardians are responsible for supervising their children's use of the Service.

Account Responsibilities: When registering, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.

5. Third-Party AI Services

FaithGPT utilizes third-party artificial intelligence services to power our platform. By using our Service, you acknowledge and agree that your data may be processed by these third-party providers, which may include but are not limited to:

• Google (Gemini API) - For AI-powered conversations and content generation
• OpenAI - For certain AI model capabilities
• Anthropic - For AI assistant functionality
• ElevenLabs - For speech-to-text and text-to-speech services
• Fal.ai - For image generation and processing

Each of these providers has their own terms of service and privacy policies. While we have agreements in place to protect your data, the processing of your information by these third parties is subject to their respective policies. We are not responsible for the practices of these third-party providers.

6. User Responsibilities and Acceptable Use

You are responsible for your use of FaithGPT and any content you create, upload, or share through the Service. You agree to use FaithGPT only for lawful purposes and in accordance with these Terms. Specifically, you agree NOT to:

• Use the Service for any illegal purpose or in violation of any applicable law
• Attempt to probe, scan, or test the vulnerability of the system or breach security measures
• Interfere with or disrupt the Service or servers connected to the Service
• Attempt to circumvent usage limits, credit systems, or subscription restrictions
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of FaithGPT without express written permission
• Use the Service to generate content that is harmful, threatening, abusive, defamatory, or otherwise objectionable
• Harass, abuse, or harm another person through your use of FaithGPT
• Submit false or misleading information or impersonate another person or entity
• Attempt to access data, accounts, or systems that you are not authorized to access
• Use automated scripts, bots, or other automated means to access or interact with the Service
• Use the Service to generate spam, phishing content, or malware
• Attempt to reverse engineer, decompile, or disassemble any portion of the Service

7. User-Generated Content

Your Content: You retain ownership of any content you create, upload, or share through FaithGPT, including prayers, notes, messages, images, and other materials ("User Content"). However, by using the Service, you grant FaithGPT AI Inc. a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Content in connection with operating and improving the Service.

AI Training: We may use anonymized and aggregated conversation data to improve our AI models and services. This data is processed in a manner that does not identify you personally. You can opt out of having your conversations used for AI training through your account settings, where available.

Content Responsibility: You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that you have all necessary rights to grant the licenses above and that your User Content does not violate any third-party rights.

8. Content Moderation

FaithGPT employs both automated and manual content moderation to maintain a safe and respectful environment. We may review, flag, remove, or restrict access to any content that violates these Terms or our community guidelines. Our moderation systems may:

• Automatically filter or block potentially harmful or inappropriate content
• Flag content for human review
• Provide safety resources when potentially concerning content is detected
• Suspend or terminate accounts that repeatedly violate our policies

While we strive to enforce our policies fairly and consistently, moderation decisions are made at our sole discretion and are final.

9. Intellectual Property Rights

Our Intellectual Property: The FaithGPT name, logo, website, applications, and all content, features, and functionality (including but not limited to software, text, displays, images, video, and audio) are owned by FaithGPT AI Inc. and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. The FaithGPT trademark, service marks, and logos are registered or unregistered trademarks of FaithGPT AI Inc.

Limited License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for your personal, non-commercial use. This license does not include the right to modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the Service.

AI-Generated Content Ownership: You own all content generated by FaithGPT's AI systems in response to your prompts and inputs ("AI-Generated Content"). FaithGPT AI Inc. does not claim any ownership rights in your AI-Generated Content. You are free to use, modify, distribute, and commercialize your AI-Generated Content for any lawful purpose, including personal, educational, and commercial uses, without requiring our permission.

AI Content Limitations: While you own your AI-Generated Content, please note that: (a) similar or identical content may be generated for other users who provide similar prompts; (b) we do not guarantee that AI-Generated Content is unique, accurate, or free from errors; and (c) you are solely responsible for ensuring your use of AI-Generated Content complies with applicable laws and does not infringe third-party rights.

10. Subscription, Credits, and Payment

Free and Premium Services: FaithGPT offers both free and premium subscription tiers. Free users receive limited daily credits that reset periodically. Premium subscribers receive additional credits and access to enhanced features.

Payment Processing: Payments on our website are processed through Stripe, and payments on our mobile applications are processed through RevenueCat (which integrates with Apple App Store and Google Play Store). By making a purchase, you agree to the applicable payment processor's terms of service. We do not store your complete credit card information on our servers.

Subscription Terms: Premium subscriptions are billed on a recurring basis (monthly or annually) until cancelled. You authorize us to charge your payment method at the beginning of each billing period. Subscription fees are non-refundable except where required by law or as expressly stated in these Terms.

Cancellation: You may cancel your subscription at any time through your account settings. Upon cancellation, you will continue to have access to premium features until the end of your current billing period. No refunds or credits will be provided for partial billing periods.

Price Changes: We reserve the right to change subscription fees with at least 30 days' notice. Continued use of the Service after a price change takes effect constitutes acceptance of the new pricing.

11. Communications

By creating an account, you consent to receive communications from FaithGPT AI Inc., including:

• Transactional emails: Account confirmations, password resets, payment receipts, and service-related notices
• Product updates: New features, changes to the Service, and important announcements
• Marketing communications: Newsletters, promotional offers, and content recommendations (you may opt out at any time)
• Push notifications: If enabled, notifications about your prayers, devotionals, and other Service features

You may manage your communication preferences through your account settings or by following the unsubscribe instructions in our emails.

12. Termination

Termination by You: You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Service will immediately cease.

Termination by Us: FaithGPT AI Inc. reserves the right to suspend or terminate your access to the Service at any time, with or without cause and without prior notice, for any reason including but not limited to:

• Violations of these Terms or our policies
• Requests by law enforcement or government agencies
• Unexpected technical or security issues
• Extended periods of inactivity
• Discontinuance or material modification of the Service
• Fraudulent, abusive, or illegal activity

Effect of Termination: Upon termination, all provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity obligations, and limitations of liability.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. FAITHGPT AI INC. SPECIFICALLY DISCLAIMS ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Without limiting the foregoing, FaithGPT AI Inc. does not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• The results obtained from the Service will be accurate, reliable, or complete
• AI-generated content will be free from errors, biases, or inaccuracies
• AI responses will align with any particular theological tradition or denomination
• Defects will be corrected or that the Service is free of viruses or harmful components

Religious Content Disclaimer: FaithGPT is designed to serve users across various Christian denominations and faith traditions. AI-generated theological content represents interpretations based on training data and may not reflect the official positions of any particular church, denomination, or religious organization. Users should consult their own religious leaders and authoritative sources for matters of doctrine and faith.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAITHGPT AI INC., ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of (or inability to access or use) the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service, including AI-generated responses
• Unauthorized access, use, or alteration of your transmissions or content
• Any decisions or actions taken based on AI-generated content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SERVICE DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM, OR (B) ONE HUNDRED CANADIAN DOLLARS (CAD $100).

Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

15. Indemnification

You agree to indemnify, defend, and hold harmless FaithGPT AI Inc., its affiliates, and their respective officers, directors, employees, agents, successors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:

• Your use or misuse of the Service
• Your User Content
• Your violation of these Terms
• Your violation of any applicable law or regulation
• Your violation of any rights of any third party
• Any claim that your User Content caused damage to a third party

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims.

16. Governing Law

These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles that would result in the application of the laws of any other jurisdiction.

17. Dispute Resolution

Informal Resolution: Before initiating any formal dispute resolution proceeding, you agree to first contact us at hello+legal@faithgpt.io to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 60 days of submission, you or FaithGPT AI Inc. may proceed to formal dispute resolution.

Jurisdiction: Subject to the arbitration provisions below, you agree to submit to the exclusive jurisdiction of the courts of the Province of British Columbia, Canada, for any disputes arising out of or related to these Terms or your use of the Service.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or arbitrator of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect, and the invalid, illegal, or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.

The failure of FaithGPT AI Inc. to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by FaithGPT AI Inc.

22. Assignment

You may not assign or transfer these Terms or your rights hereunder, in whole or in part, without the prior written consent of FaithGPT AI Inc. FaithGPT AI Inc. may assign or transfer these Terms, in whole or in part, without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.

23. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and FaithGPT AI Inc. regarding your use of the Service and supersede all prior and contemporaneous written or oral agreements, communications, and other understandings relating to the subject matter hereof.
